Buyer & Seller Contracts Are Mandatory By Florida Law

For the Buyer & The Seller – Written Broker Contracts Are Mandatory

State of Florida Real Estate Law says that if a buyer walks into a commercial real estate office, or calls the brokerage to see a property, real estate agents can only show you just their office listings - not the many MLS Listings of other brokers that you may want to see; that's because at that point you are treated at first as a customer - not a client.

Put another way, a Buyer walks into our office and wants to see just one of the agencies listings. The Law is you can only show that buyer your own office listings, and no other agencies listings without a signed buyer contract. In this instance you are treated like a customer – not a client.

For the agent to show all the commercial listings of other brokerages, the buyer must sign a "Buyer Contract" with the brokerage, and then will become a client which will then allow full access to all MLS listings. Our agency policy with buyer contracts is a buyer can cancel their contract with our agency if they are unhappy by giving us specific written notice, BUT this is providing we have not made offers to purchase on your behalf, or in the purchase phase of a property; then we will sign off and wish you luck.

Selling a commercial builing or land requires a written Florida Bar approved listing contract. Verbal listing or purchase contracts are not allowed. Simply because the subject at hand is real property.

Two Types of Purchase Offer Contracts Used

Buyers wanting to make an offer on a property will be governed by how the "seller" and "its broker" specified in the listing whether they will use of the "Standard" purchase contract - or the "As-Is" purchase contract. The as-is means what it says, the seller won't be making repairs or any changes to the property you request "what you see is what you will be buying". You can still do a property inspection; however the seller will not recognize any deficiencies unless they are structural or major items.
